WASHINGTON (AP) — A federal ruling in Washington, D. C. , has ruled that only part of the lawsuit filed against former President Donald Trump over the death of Capitol Police Officer Brian Sicknick can move forward, leading to a split resolution in the lawsuit. presented through its old component.
U. S. District Court Judge Amit Mehta ruled Tuesday that Sicknick’s partner, Sandra Garza, can file her civil lawsuit against Trump over the officer’s death after Jan. 6, 2021, but on two of the counts. Mehta has ignored civil wrongful death charges. and negligence against Trump, but will allow Garza’s claims against Trump under the D. C. Survival Act to continue. The Survivorship Act allows a person’s legal representative to file a lawsuit on their behalf after their death. Garza is the representative of Sicknick’s estate.
Garza has filed a lawsuit against Trump, as well as Jan. 6 defendants George Tanios and Julian Khater. Khater was sentenced to more than six years in criminal punishment after admitting to spraying the officer. Tanios pleaded guilty to misdemeanor charges. Neither has been criminally charged in Sicknick’s death.
“We are pleased to see that our trial judge for Capitol Police Officer Brian Sicknick, who died as a result of the Jan. 6 insurrection, has been able to continue. We are now contemplating our next steps, adding impeachment to the former president. Trump,” said Mark Zaid, one of the attorneys representing Garza.

Medical Examiner’s OfficeHe had said in the past that Sicknick died of herbal reasons after suffering two strokes at the base of his brainstem caused by a clot in an artery and noted that “everything that happened played a role in his condition,” a reference. In Sicknick’s experience, he will defend the Capitol on Jan. 6.
In another criminal case, Trump is accused of attempting to nullify the effects of the 2020 presidential election, and added through his moves around Jan. 6. Trump has continually denied any culpability in the attack.
